Do I need to visit the US to set up my LLC?
No. Formation, EIN and most bank applications are done entirely online and by mail. Many of the people we work with have never been to the US.
Can a non-US resident open a US business bank account?
Yes, but not at every bank. Big banks like Chase and Bank of America usually require an in-person visit. Online banks and fintechs such as Mercury, Relay and Wise accept non-US owners with your formation documents, EIN and passport. We help you pick the right one and prepare a complete application. The bank makes the final decision.
How long does the whole process take?
Formation usually takes 3–7 business days depending on the state. An EIN for a non-US owner takes from a few days to several weeks, depending on the IRS. Bank approval adds a few days. Most founders are fully set up in 2–4 weeks.
Do I have to pay US tax as a non-resident?
It depends on where your income comes from and how your business operates. Many foreign-owned single-member LLCs with no US-based activity owe no US income tax, but they still must file Form 5472 with a pro forma Form 1120 every year. We review your situation, and a licensed US tax professional confirms anything that needs a formal opinion.
What is Form 5472, and what happens if I miss it?
Form 5472 reports transactions between a foreign-owned US company and its owner, such as money you put in or take out. It's due with the company's annual return. The IRS penalty for not filing starts at $25,000, even if the company made no money.
Wyoming or Delaware?
For most freelancers, agencies, Amazon sellers and SaaS founders, Wyoming is simpler and cheaper to maintain. Delaware makes sense if you plan to raise venture capital. We'll recommend a state based on your plans on your free call.
Do I need to file a BOI report?
Since March 2025, FinCEN no longer requires companies formed in the US to file beneficial ownership (BOI) reports, including US LLCs owned by non-residents. We'll let you know if the rules change.
I already have an LLC. Can you help with just compliance?
Yes. Annual reports, Form 5472, bookkeeping and registered agent changes are all available on their own. Tell us where you are and we'll pick up from there.
What documents do I need to start?
Usually a passport copy, your home address, two or three company name ideas and a short description of your business. You'll get a full checklist after your call.
Are you a law firm or CPA?
No. We're a business formation, compliance and bookkeeping service. Tax returns are reviewed and e-filed by a licensed US tax professional, and if your situation needs legal advice, we'll tell you so and suggest you speak to an attorney.
